THE BEDÖ SYSTEM™ — TERMS OF USE, CONFIDENTIALITY & LIABILITY WAIVER

Confidentiality & Non-Sharing. Your account is personal to you and non-transferable. You may not share, lend, resell, sublicense, or give any other person or business access to the app, your login credentials, or any of its content, programming, exercises, methods, or materials. The Bedö System™ — its curriculum, exercise library, and programming logic — is the confidential, proprietary property of Bedö Works™. You agree to keep it strictly confidential both during and after your use, and to use it solely to serve your own authorized clients. Sharing or disclosing access is grounds for immediate termination and may result in legal action.

Assumption of Risk & Liability Waiver. You accept full professional responsibility for your instruction, assessments, and programming decisions. To the fullest extent permitted by law, you release, waive, and hold harmless Bedö Works™ from any claim, injury, loss, or damage arising from your use of the system or your instruction of clients. You are solely responsible for obtaining appropriate client waivers, informed consent, and physician clearance where needed.

1. Professional Use Only

This system is a programming and education tool for certified Pilates instructors. It may only be used by qualified movement professionals acting within the scope of their certification, training, and applicable local law/licensing requirements.

2. Not Medical Advice

Movement screens, pose-estimation overlays, flagged deviations, Coach Bedö responses, and suggested exercises are informational observations — they are not medical diagnoses, treatment, or clinical findings. Clients with injuries, medical conditions, or pregnancy should be cleared by a physician before beginning any program.

3. Instructor Responsibility & Client Waivers

You exercise independent professional judgment at all times. AI-flagged observations and Coach Bedö suggestions are approximations that must be verified by your own assessment before acting on them. Exercise selection, contraindication screening, and client safety remain solely your responsibility. Before providing in-person instruction, you are solely responsible for obtaining your own separate, signed liability waiver and assumption-of-risk / informed-consent form from each client, appropriate to your business and jurisdiction — this system does not provide, replace, or substitute for that document.

4. Client Privacy & Consent

You must obtain informed client consent before recording photos, video, or audio, and before storing health history. Client records are confidential; do not share them outside professional use. This system is not HIPAA-certified infrastructure — do not store data that requires it.

5. Video & AI Analysis Disclaimer

Pose-detection analysis runs locally in your browser using an estimation model; recorded video clips are uploaded to your private cloud storage account (see Privacy Policy). Joint positions, angles, deviation flags, and Coach Bedö's responses are approximate, AI-generated observations and may be inaccurate or incomplete. They must never be presented to a client as a diagnosis or as guaranteed-accurate.

6. AI Accuracy & Limitations

Pose detection, deviation flagging, and Coach Bedö are AI-assisted tools, not diagnostic or clinical-decision instruments. Movement-screening accuracy varies with conditions (lighting, angle, posture) and is lower in challenging environments; Coach Bedö, like any AI assistant, can produce incorrect, incomplete, or outdated responses. False positives and false negatives occur. You are solely responsible for independently verifying any AI-flagged observation or AI-generated suggestion before relying on it or presenting it to a client. Bedö Works™ does not warrant the accuracy of any AI output and disclaims liability for decisions made in reliance on it.

7. Limitation of Liability

The Bedö System™ is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. To the maximum extent permitted by law: (a) Bedö Works™ disclaims all liability for training decisions, client injuries, data loss, service interruptions, or damages of any kind arising from use of this system; (b) Bedö Works™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages; and (c) Bedö Works™'s total aggregate liability for any claim arising from these Terms or your use of the system shall not exceed the amount you paid to Bedö Works™, if any, in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Bedö Works™ from any claim, damage, or expense (including reasonable attorneys' fees) arising from your use of the system, your instruction of clients, your failure to obtain appropriate client waivers or consent, or your violation of these Terms.

9. Termination

Bedö Works™ may suspend or terminate your access at any time for violation of these Terms, misuse of the system, or non-payment, with or without notice.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Dallas County, Texas.

11. Your Data

Client data syncs to your private, access-controlled cloud account. You control it and are responsible for deleting records a client asks you to remove. Terms acceptances are logged for audit purposes.

12. Changes to These Terms

We may update these Terms; material changes require re-acceptance before continued use (as you are doing now). Continued use after acceptance constitutes agreement to the current version.

Data We Collect

From Instructors: Name, email, password (hashed), studio/business info, client roster, program notes.

From Clients: Health history (injuries, conditions, medications), age, goals, experience level, assessment notes, video recordings (movement analysis), movement metrics (pose-estimated joint angles), body composition measurements (InBody or equivalent body-composition scans recorded by your instructor — weight, skeletal muscle mass, body fat percentage, visceral fat level, basal metabolic rate, and segmental lean values), progress photographs, instructor observations, progress notes.

Body composition data: These readings are entered manually by your instructor from a scan you took; the platform does not connect to any scanning device and receives no data from one directly. They are recorded for progress tracking only and are not used to generate or alter your program. They are deleted on the same terms as the rest of your data (see Retention below). If you would prefer your instructor not record them, they can be left out entirely — the platform does not require them.

How We Use Your Data

Core Platform: Program design, movement analysis, deviation detection, progress tracking, corrective exercise suggestions.

Business Operations: Studio revenue tracking, client roster management, usage statistics, compliance logging.

Improvement: Anonymized usage patterns may be analyzed to improve AI accuracy and user experience.

Legal/Safety: Data retained for audit, legal compliance, and to respond to court orders or regulatory requests.

Where Data Is Stored

All data is stored on Supabase (PostgreSQL database) hosted on AWS in the US. Your data is encrypted in transit (TLS/SSL) and at rest. Backups are retained for 30 days. Access is restricted to your instructor account and Bedö Works™ administrators (for support/compliance only).

IMPORTANT: This system is not HIPAA-compliant infrastructure. Do not store data requiring HIPAA protection (such as data from a licensed healthcare provider's medical records). This is a fitness programming tool, not a medical records system.

Data Retention & Deletion

During Account Active: All data retained as long as account is active.

Client Deletion Requests: When a client asks for deletion, all their data (health history, notes, videos, body composition readings, progress photographs) is deleted within 7 days. Backup copies purged within 14 days.

Account Closure: When an instructor account closes, all associated client data is retained for 90 days (for legal holds), then deleted.

Prospect Data: If a prospect never converts to client, their data is deleted within 90 days by default (instructor may customize this).

Your Rights

Access: You can download your data at any time (CSV export available in Admin panel).

Correction: You can update or correct any of your data.

Deletion: You can request deletion of your account and all associated data. Deletion is permanent.

Portability: You can export your data to share with another instructor or system.

Privacy Choices: You control video consent for each client recording. Clients can decline recording or ask for clips to be deleted.

Additional rights by law: Depending on where you or your clients are located, applicable law (e.g. the California Consumer Privacy Act, or the EU/UK GDPR) may grant additional rights — such as the right to know, opt out, or lodge a complaint with a regulator. We will honor valid requests made under such laws to the extent they apply.

Children's Privacy

This system is intended for use by adult instructors working with clients of any age under the instructor's professional supervision. It is not directed at children, and minors should only be entered as clients with a parent/guardian's informed consent obtained by the instructor outside this system.

Third Parties, Subprocessors & Integrations

Anthropic (Coach Bedö): If you use the Coach Bedö AI assistant, your message and relevant client context (discovery notes, scores, flags) are sent to Anthropic's API to generate a response. This requires you to be signed in. Data sent is handled per Anthropic's API data-use policies (not used to train their models by default) — see https://www.anthropic.com/legal/privacy for current terms, as retention windows are set by that provider, not by us.

No other third parties. We do not sell, rent, or share your data with marketers, advertisers, or any other service without your explicit consent.

Security

We take data security seriously. Access controls, encryption, and audit logging are in place. However, no system is 100% secure. If we discover a data breach, we will notify affected users within 48–72 hours and disclose what data was exposed and remediation steps taken.

Changes to This Policy

We may update this policy. Changes are effective 30 days after posting. Continued use means acceptance.

LIABILITY WAIVER & ASSUMPTION OF RISK
In this waiver, the words “lesson” and “session” are used interchangeably and refer to the same Pilates instructional activity with this instructor.

1. Assumption of Risk

Pilates and related exercise instruction (Mat, Reformer, and other apparatus) involve physical movement and carry an inherent risk of injury, including but not limited to muscle strain, joint injury, and, in rare cases, more serious harm. I understand these risks and voluntarily choose to participate.

2. Medical Clearance

I confirm that I am not aware of any medical condition that would prevent my safe participation, or I have been cleared by a physician to participate. I will inform my instructor of any injury, condition, medication, or pregnancy that could affect my lesson, and I understand it is my responsibility to keep this information current.

3. Not Medical Advice

I understand that movement screens, AI-assisted movement analysis, and any exercise recommendations provided through this system are fitness observations, not medical diagnoses or treatment, and are not a substitute for professional medical care.

4. Release of Liability

In consideration of being allowed to participate, I release and hold harmless my instructor and Bedö Works™ from any claim, liability, or expense arising from my participation, except to the extent caused by gross negligence or willful misconduct.

5. Photos, Video & Data

I understand that if I agree to movement-analysis video recording, a separate consent screen will describe how that specific recording is used and stored, and that my health information is handled as described in the Privacy Policy.

6. Voluntary & Ongoing

My participation is voluntary. I may stop any exercise or lesson at any time. This waiver applies to all lessons with this instructor unless I withdraw it in writing.
